The due date for filing Form 1099-MISC, Form W-2 and Form W-3 is now January 31, 2017, previously February 28th. Please note the January 31, 2017 deadline for filing the Form 1099-MISC only applies if you are reporting non-employee compensation in Box 7. The filing deadline for all other Forms 1099 remains at February 28, 2017. If needed, there is an extension of time available for the filing of these forms and instructions for the filing of an extension is explained below.

Extensions of time to file

Form W-2

Extensions of time to file Form W-2 with the SSA are no longer automatic. For filings due on or after January 1, 2017, you may request one 30-day extension to file Form W-2 by submitting a complete application on Form 8809 – Application for Extension of Time to File Information Returns no later than January 31, 2017. The extension should include a detailed explanation of why you need additional time to file and signed under penalties of perjury. The IRS will only grant the extension in extraordinary circumstances or in a catastrophe.

Form 1099-MISC Reporting Non-employee Compensation in Box 7

You may obtain an automatic 30-day extension of time to file Form 1099-MISC by completing Form 8809. This form may be submitted on paper or through the Internal Revenue Service’s Filing Information Returns Electronically System (FIRE System) either as a fill-in form or electronic file. The FIRE System can be accessed at No signature or explanation is required for the extension, but you must file Form 8809 by January 31, 2017 in order to get the 30-day extension.
